Terms & Conditions
Please read these Terms & Conditions carefully.
By entering a WinAClassic Competition you confirm that you have read, understood and agree to be bound by these Terms & Conditions.
These Terms & Conditions apply to competitions and prize draws promoted under the WinAClassic brand and, where applicable, Win A Classic .
Promoter: David Page trading as WinAClassic (the “Promoter”, “we”, “us” or “our”).
Website: WinAClassic.co.uk and any associated website or page operated by the Promoter in connection with a Competition.
1. Definitions
Competition means an individual competition, prize draw or promotion advertised by the Promoter.
Entrant means a person who enters a Competition.
Prize means the prize advertised for the relevant Competition.
Winner means the eligible Entrant whose valid entry is selected in accordance with these Terms & Conditions.
Entry means a valid paid entry or valid free postal entry, as applicable.
2. Eligibility
2.1 Competitions are open to persons aged 18 or over who reside in the United Kingdom, unless a particular Competition expressly states otherwise.
2.2 Employees of the Promoter, persons directly involved in operating or administering a Competition, their immediate family members, professional advisers and anyone otherwise directly connected with the operation of the Competition are not eligible to enter.
2.3 The Promoter may refuse or cancel an Entry where it reasonably believes that an Entrant has breached these Terms & Conditions or attempted to manipulate, abuse or interfere with a Competition.
2.4 Entrants are responsible for ensuring that participation is lawful in the country in which they reside.
3. Account Registration
3.1 An Entrant must register for an account on the Website before entering a Competition, unless the relevant Competition expressly provides otherwise.
3.2 Entrants must provide accurate and complete information and keep account details up to date.
3.3 An account may only be used by the person to whom it belongs. Entries made using another person's account may be cancelled.
3.4 The Promoter may suspend or close an account where it has reasonable grounds to believe it is being used fraudulently, abusively or contrary to these Terms & Conditions.
4. How to Enter
4.1 Each Competition will display its entry price, maximum number of entries, closing date and other relevant restrictions on its individual Competition page.
4.2 For a paid Entry, the Entrant must select the Competition, select the required number of Entries/tickets, answer the applicable skill-based question correctly, complete checkout and make the required payment.
4.3 A paid Entry is not valid until payment has been successfully authorised and the Entry has been recorded in the Promoter's systems.
4.4 Ticket numbers may be allocated automatically. The ticket number recorded in the Promoter's official Competition records is the number used for the draw.
4.5 Maximum Entries per person may vary by Competition and will be stated on the relevant Competition page.
5. Free Postal Entry Route
Free entry is available by post.
The free postal entry route is an essential part of the Competition structure and provides an alternative to paying to enter.
5.1 An Entrant may enter an applicable Competition by sending an unenclosed postcard or letter by post.
The postal entry must include:
Full name
Full postal address
Date of birth
Telephone number
Email address
Name of the Competition or Prize
The answer to the applicable Competition question
5.2 The postal entry must be received before the applicable Competition closing date.
5.3 Details supplied on the postal entry must correspond with the Entrant's registered account.
5.4 Each postal entry must be submitted separately unless the individual Competition page states otherwise.
5.5 The Promoter is not responsible for postal entries that are lost, delayed, damaged or incorrectly addressed.
5.6 Postal Entrants will be included in the same Competition and prize allocation process as paid Entrants. The Promoter will not deliberately favour a paid Entry over a valid free postal Entry.
5.7 The free postal entry route will be displayed or otherwise publicised in connection with applicable Competitions. Entrants should follow the postal instructions displayed for the relevant Competition.
6. Skill-Based Question
6.1 Where a Competition requires a question to be answered, the Entrant must submit the correct answer before an Entry can be accepted.
6.2 The question is intended to require the Entrant to exercise skill, knowledge or judgement.
6.3 The Promoter may reject an Entry where the required answer has not been correctly submitted.
7. Competition Period and Closing
7.1 Each Competition will have a stated closing date, maximum number of Entries, or both.
7.2 A Competition may close when the maximum number of Entries is reached or on the published closing date, whichever applies.
7.3 The Promoter may extend a closing date where reasonably necessary, provided the Competition continues to operate consistently with its published information and these Terms & Conditions.
7.4 The Promoter may cancel a Competition before a Winner is selected. Where a Competition is cancelled, affected Entries and payments will be dealt with in accordance with the circumstances and applicable law.
8. Draw and Winner Selection
8.1 After a Competition closes, all valid and eligible Entries will be included in the Winner selection process.
8.2 The Winner will be selected using a random number generator or other independently verifiable random selection process appropriate to the Competition.
8.3 Where a random number generator is used, the range will correspond with the valid Entries participating in the Competition.
8.4 The Promoter intends to livestream Competition draws through its social media channels where practical. A livestream is not a condition of a valid Competition.
8.5 The Promoter's Competition records constitute the definitive record of valid Entries and ticket numbers, subject to correction of any proven technical or administrative error.
8.6 The result will be announced on the Website and/or the Promoter's social media channels.
9. Contacting the Winner
9.1 The Promoter will attempt to contact the Winner using the contact details held on the Winner's account.
9.2 The Winner must respond within seven days of the Promoter's first reasonable attempt to contact them unless the Promoter agrees otherwise.
9.3 The Promoter may require reasonable proof of identity and proof that the Winner is the registered account holder before releasing a Prize.
9.4 If the Winner cannot be contacted, fails to provide required verification, or is found to be ineligible, the Promoter may require the Prize to be forfeited and may conduct a further selection from remaining valid Entries where appropriate.
10. Prizes
10.1 The Prize for each Competition will be described on its individual Competition page.
10.2 Unless expressly stated otherwise, the Winner is entitled only to the Prize described and not to a cash alternative.
10.3 If a Prize becomes unavailable for reasons outside the Promoter's reasonable control, the Promoter may substitute a Prize of equal or greater value, subject to applicable law.
10.4 Prize specifications, colours, models, accessories and other details are those stated on the relevant Competition page.
10.5 Where a Prize is a vehicle, it will be supplied in the condition described on the Competition page. Unless expressly stated otherwise, the Promoter does not provide a separate warranty as to future performance, condition or suitability.
10.6 The Winner is responsible for ongoing Prize costs including insurance, taxation, registration, servicing, maintenance, fuel, travel and other ownership costs unless expressly stated otherwise.
11. Prize Delivery
11.1 Where delivery is included, the Promoter will agree reasonable delivery arrangements with the Winner.
11.2 Delivery outside the UK mainland may incur additional charges or may not be available, depending on the Prize.
11.3 The Promoter is not responsible for costs imposed by authorities or third parties in connection with importing, registering, insuring or otherwise receiving a Prize.
12. Publicity and Winner Announcements
12.1 The Promoter may announce the Winner's name, subject to applicable privacy and data protection requirements.
12.2 Any use of a Winner's photograph, video, interview or likeness for promotional purposes will be handled in accordance with applicable law and any required consent.
12.3 The Promoter will not publicly disclose a Winner's private contact details.
13. Refunds and Cancellation
13.1 Entries are normally final once submitted and paid for, except where a refund is required by law or under these Terms & Conditions.
13.2 If the Promoter cancels a Competition, it will communicate the applicable refund or alternative arrangement to affected Entrants.
13.3 Nothing in these Terms & Conditions excludes or limits any consumer right that cannot lawfully be excluded or limited.
14. Fraud, Abuse and Prohibited Conduct
14.1 Entrants must not attempt to manipulate a Competition, create fraudulent accounts, use payment methods without authority, interfere with the Website, exploit software faults or use automated systems to gain an unfair advantage.
14.2 The Promoter may cancel Entries and/or suspend or close accounts where it has reasonable grounds to believe an Entrant has acted fraudulently, abusively or unlawfully.
14.3 The Promoter may retain evidence relating to suspected fraud or abuse and disclose information where required by law or to prevent or detect crime.
15. Website and Technical Problems
15.1 The Promoter will use reasonable endeavours to keep the Website and Competition systems operating correctly.
15.2 The Promoter cannot guarantee uninterrupted availability of the Website or payment systems.
15.3 If a technical problem materially affects fairness or integrity, the Promoter may suspend, correct, extend or cancel the Competition as reasonably necessary.
15.4 Where a technical or administrative error results in an incorrect Winner being identified, the Promoter may investigate and take reasonable corrective action.
16. Liability
16.1 Nothing in these Terms & Conditions excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
16.2 Subject to clause 16.1, the Promoter is not responsible for losses caused by circumstances outside its reasonable control, including telecommunications failures, internet outages, third-party service failures, postal delays, computer failures or other events beyond reasonable control.
16.3 Nothing in these Terms & Conditions affects statutory consumer rights.
17. Data Protection
17.1 Personal information supplied by Entrants will be processed for administering Competitions, processing payments, contacting Entrants and Winners, preventing fraud, fulfilling Prizes and complying with legal obligations.
17.2 Personal information will be handled in accordance with the Promoter's Privacy Policy.
17.3 Payment information may be processed by third-party payment providers. The Promoter does not normally have access to full payment-card details.
18. Marketing Communications
18.1 Entrants may receive transactional communications relating to their account, Entries, Competitions and Prizes.
18.2 Promotional communications will be sent in accordance with applicable data protection and electronic marketing laws and the Entrant's communication preferences.
19. Charitable Donations
19.1 Where a Competition specifically states that a charitable donation will be made, the relevant Competition page will identify the applicable donation arrangement.
19.2 Where stated, the Promoter may donate 10 pence (10p) per qualifying ticket to charities selected by the Promoter.
19.3 A Competition promoted specifically for a named charity will contain its own details regarding the amount or proportion being donated.
20. Competitions and Gambling Law
20.1 WinAClassic is intended to operate applicable promotions as free draws and/or prize competitions rather than as licensed gambling.
20.2 Where a Competition offers paid Entries, the Promoter will also provide the free postal entry route described in these Terms & Conditions.
20.3 The free postal route is intended to provide an alternative to paying to participate. Valid free and paid Entries will be included in the relevant Competition's prize allocation process without the Promoter deliberately favouring paid Entries.
20.4 The Promoter will operate each Competition in accordance with the published Competition information and these Terms & Conditions.
20.5 The Promoter does not represent that every future promotion, game or feature appearing on WinAClassic will automatically have the same legal classification. A materially different format may require separate legal review.
21. Changes to these Terms
21.1 The Promoter may update these Terms & Conditions from time to time.
21.2 The Terms & Conditions applicable to an Entrant's Competition entry will be the version displayed at the time of entry, except where a change is required by law or necessary to correct an error.
22. Severability
22.1 If any provision is found to be invalid, unlawful or unenforceable, it will be treated as removed to the extent necessary and the remaining provisions will continue to apply.
23. Governing Law and Jurisdiction
23.1 These Terms & Conditions are governed by the law of England and Wales.
23.2 Subject to mandatory consumer rights, disputes arising from these Terms & Conditions will be subject to the jurisdiction of the courts of England and Wales.
24. Contact
If you have a question about a Competition, your Entry or these Terms & Conditions, please contact the Promoter through the contact details displayed on WinAClassic.co.uk.
Legal position notice:
The Keystone Law opinion dated 25 September 2023 was provided to David Page trading as Win A Classic. It concluded, on the facts supplied to Keystone Law, that the Win A Classic draws described in that opinion did not fall within the statutory definitions of gaming, betting or participating in a lottery.
The opinion specifically considered the genuine free postal entry route.
This document is an updated set of website Terms & Conditions and is not a new legal opinion from Keystone Law, nor should it be presented as one.
Version: September 2026
These Terms & Conditions have been structured from the Win A Classic terms supplied with the Keystone Law advice and adapted for the WinAClassic brand. The original advice was specifically instructed for David Page trading as Win A Classic and did not constitute advice on the adequacy or legality of the proposed terms themselves.
